This morning, the Nuon Chea Defence Team filed a third application for the disqualification of International Trial Chamber judge Silvia Cartwright. The application was filed in response to recent statements Cartwright made in open court as well as to the New Zealand press. In both cases her comments demonstrated actual bias against Nuon Chea and, in the alternative, would lead a reasonable observer, properly informed, to apprehend bias on her part.
The previous applications for disqualification were rejected.
